Terms of Service
1. Acceptance of Terms
By accessing or using nuit.archi and the Nuit web application (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
Nuit is an AI-powered design exploration tool that generates architectural and interior design concepts from text descriptions. The Service includes exterior concept generation, floor plan generation, interior room visualization, and related features.
3. Account Registration
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 16 years old to use the Service.
- You are responsible for all activity that occurs under your account.
- One person or entity may not maintain more than one free account.
4. Credits and Billing
4.1 Credits
The Service uses a credit-based system. Each image generation consumes credits. Credit costs are displayed before generation. Credits are non-refundable except where required by applicable law.
4.2 Free Tier
New accounts receive a one-time allocation of free credits. Free credits cannot be transferred and have no cash value.
4.3 Subscriptions
Paid subscriptions provide a monthly credit allowance. Monthly subscription credits reset at each billing cycle and do not roll over. Subscriptions automatically renew unless cancelled before the next billing date.
4.4 Credit Packs
One-time credit pack purchases are available on paid plans. Purchased credits do not expire and carry over indefinitely. Discount rates apply based on your subscription tier.
4.5 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to all generated content after cancellation. No refunds are provided for partial billing periods except where required by law.
5. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Generate content that infringes on intellectual property rights of third parties.
- Attempt to reverse-engineer, decompile, or extract the AI models used by the Service.
- Use automated tools (bots, scrapers) to access the Service without our written permission.
- Resell, sublicense, or redistribute the Service itself (as opposed to content you generate).
- Interfere with or disrupt the Service or its infrastructure.
- Impersonate any person or entity, or misrepresent your affiliation.
- Create multiple accounts, or use any automated or manual means, to circumvent usage limits, free-tier credit allowances, or other restrictions of the Service. We may suspend or terminate accounts involved in such activity.
- Submit content, or generate content, in breach of the acceptable-use policies of the AI model providers whose models power the Service. Those policies vary between providers, and the provider that handles a request depends on the model you select.
- Access or use the Service from, or on behalf of anyone in, a country or region subject to comprehensive economic sanctions, or where the Service is not available under the terms of our technology providers or applicable export-control and sanctions laws. You represent that you are not located in such a region and are not on any government restricted-party list. We may restrict or block access based on your location.
6. Intellectual Property
6.1 Your Content
You retain ownership of the text prompts, reference images, and other content you provide to the Service (“Your Input”). You grant us a limited license to process Your Input solely for the purpose of providing the Service.
Providing the Service includes transmitting Your Input to the third-party AI provider behind the model you select, so that an image can be generated and returned to you. That provider processes Your Input under its own terms and privacy policy. Our Privacy Policy describes which providers may be involved and how their retention and training policies differ.
6.2 Generated Content
Subject to these Terms, to applicable law, and to the terms of the AI provider whose model produced the image, you own the images generated by the Service based on your prompts (“Generated Content”). You may use Generated Content for personal and commercial purposes, including client presentations, marketing materials, and publications.
Rights in Generated Content originate with the provider of the model that produced it, and provider terms are not identical across the models we offer. We pass through to you the broadest rights each provider grants us, but we cannot grant more than we hold. If a specific commercial use depends on the terms attached to a particular model, our Privacy Policy publishes the provider behind every model together with a link to that provider’s terms.
We do not claim ownership of your Generated Content. However, we cannot guarantee that Generated Content does not resemble existing works. You are responsible for ensuring your use of Generated Content complies with applicable intellectual property laws.
6.3 Our Intellectual Property
The Service, including its design, code, branding, and underlying technology, is owned by Nuit and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
7. AI-Generated Content Disclaimer
Content generated by the Service is produced by AI models and is intended for conceptual exploration purposes. Generated images:
- Are not architectural drawings, construction documents, or engineering specifications.
- Should not be relied upon for structural, safety, or regulatory compliance purposes.
- May not accurately represent real-world dimensions, proportions, or building codes.
- May occasionally produce unexpected or inaccurate results.
You are solely responsible for any decisions made based on Generated Content. Always consult qualified professionals for architectural, engineering, and construction matters.
7.1 AI Provenance Marking
Article 50 of the EU Artificial Intelligence Act requires AI-generated images to be identifiable from the file itself. Images you download from the Service therefore carry a standard IPTC Digital Source Type tag in their metadata, marking them as produced by a trained algorithmic model.
The tag is invisible, does not alter the image, and contains no information about you, your project, or your prompts. It is a regulatory requirement rather than branding, and it also serves as proof of origin should a client, competition, or publisher ask how an image was made. Marking cannot be disabled. Images generated before 13 August 2026 are not marked retroactively.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We are not liable for any loss resulting from Service downtime.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Nuit and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Any loss of profits, revenue, data, or business opportunities.
- Any damages resulting from your use of or inability to use the Service.
- Any damages resulting from unauthorized access to your account or data.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.
12. Indemnification
You agree to indemnify, defend, and hold harmless Nuit and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive (including intellectual property, limitation of liability, and indemnification).
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Nuit is established, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nuit regarding the Service and supersede all prior agreements and understandings.
